EVA Airways Corporation (the “Organizer”) is the campaign holder. Passengers who have confirmed tickets on EVA/UNI Airways International flights (excluding codeshare flights) during the campaign period are qualified to participate this campaign. The Organizer shall take charge of the prize claiming of the winners.

Should there be any transaction cancellation or refund of the preorder purchase during the campaign period it is not eligible to the campaign. Once the prize claimed, the Organizer will not accept further request for refund.

All prizes shall be subject to stock availability. The Organizer has the right of replacing the prizes with the other items of equal value without notice.

The eligibility of prize claiming is non-transferrable. The prize cannot be transferred or exchanged for any other item or monetary value. The Organizer withholds the responsibility for any maintenance or warranty of the prizes.

The prizewinners of the “WEEKLY LUCKY DRAW” shall contact the Product Customer Service as early as possible. To fill out and submit the prize claiming form before December 26, 2022. Failure of submitting the required form by due date shall be deemed as a waiver of prize claiming. The unclaimed prize will be voided.

Names of the winners of “EUROPE FLIGHT TICKETS” will be announced on the EVA SKY SHOP website (www.shopeva.com) at 12 p.m. on (Monday) December 19, 2022. A notification e-mail with prize claiming details will be sent to the winners accordingly. The following table shows the relevant schedule.

Each winner needs to fill in the complete personal information (name, phone number, address and e-mail), attaches a copy of both sides of the Identity Card (or copy of the Resident Certificate or passport) and a copy of the purchase receipt. If the Organizer cannot contact the winner due to errors in the submitted forms, the winner will be deemed as a waiver of the rights. The Organizer will not notify the winner or draw another one.

Each winner shall submit the required forms to claim the prize according to the above schedule by sending a registered mail (with the postmark as proof) to the Product Customer Service located at 9F, Second Training Center, No. 376, Sec. 1, Hsin-Nan Rd., Luchu Dist., Taoyuan City, 33801, and save the registered mail receipt. The winner can choose to scan the required forms and send them to the mail of the Organizer at shopping@evaair.com and shall have the reply from the Organizer. The required forms of prizes claiming provided after the deadline will not be accepted.

The reasons including lost registered mails, broken envelopes or others are non-attributable to the Organizer, and lead into the required forms for prizes claiming being lost or unclear to recognize, or the forms provided by the winner is not complete. All the above situations may cause the winners to be ineligible to claim the prizes, and the winners agree the Organizer shall not take any responsibility.

If the winner is ineligible, disagree, is found to engage in intentional malpractice, or is an identity theft to participate this campaign, the Organizer reserves the right to cancel the winner's eligibility to claim the prize as well as the rights to take legal actions to the infringement of the Organizer or any third parties.

Winners agree that all of the data and records of participation this campaign shall be subject to the computer system and time records of the Organizer. If winners’ prize claiming form is lost, erroneous or unclear to recognize due to any computer, Internet, telephone, technical issues or any issues that are not attributable to the Organizer, the Organizer shall not take any legal liability, and winners may not object.

The Organizer may use the personal data provided by the winners exclusively for this campaign and shall follow the Personal Data Protection Act to protect winners’ rights and interests. Winners agree that their personal data may be collected, processed and utilized on computers, and not for the other purposes by the Organizer. Winners also authorize the Organizer to announce their name partial publicity.

For the winner who is under the age of 20, the legal guardian shall need to submit required documentation to claim the prize.

For the prize won by chance, please follow below rules from the Income Tax Act:
Where a taxpayer is an individual residing within the territory of the Republic of China, 10% of the full payment is withheld. The tax to be withheld and paid each time by the tax withholder does not exceed NT$2,000, the tax is exempted from being withheld. Where the annual income paid to a taxpayer does not exceed NT$1,000, the taxpayer is not required to file a withholding report to the tax collecting authority-in-charge. The copy of Identity Card or the Resident Certificate shall be provided to the Organizer for the tax reporting and the prize won by chance may be listed on individual income tax declaration. Where a taxpayer is an individual not residing within the territory of the Republic of China, 20% of the full amount is withheld. The copy of passport shall be provided to the Organizer for the tax reporting.
EVA Airways shall collect taxes of the prizes according to Taiwan’s law. If the winner cannot pay the required taxes on time, he/she will be deemed as a waiver of the rights to claim the prize. Any other details not specified herein shall be governed by the Income Tax Act. According to Article 94-1 of the Income Tax Act and in cooperation with the implementation of paperless by the National Taxation Bureau, Ministry of Finance, starting in 2014, any income tax certificate that meets certain requirements will not be sent to the taxpayer, in principle, if the issuer of the certificate has filed the certificates with the National Taxation Bureau on time.

The prizes of the EVA Airways Corp. Facebook Fan Page event will be limit to send to Taiwan, Kinmen, Penghu and Matsu. The Organizer will not mail the prizes overseas.

For any details not specified in this page, the Organizer reserves the right to hold, revise, suspend and explain the terms of the campaign. Any revision will be published on the website without a further notice.

You are free to choose whether to provide your relevant personal data. However, if you refuse or disagree to let the Organizer collect, process, or use your relevant personal data, you may not continue participating the lucky draw. If the personal data that you provided is incomplete or inaccurate, the Organizer may not be able to provide relevant services of the subsequent draws.

The Complimentary Ticket Certificate must be exchanged before December 31, 2023. Mileage accumulation and mileage upgrade awards do not apply to Complimentary flight tickets.

Winners shall pay airport taxes, fuel surcharges, taxes on prize winnings as well as other relevant taxes. The amount shall be calculated based on the tax amount of the issuance day of the ticket.

We recommend making a reservation as early as possible prior to your trip (class codes: N for economy and E for premium economy) and bring the original copy of the certificate to the EVA Airways ticketing counter to exchange the certificate for a flight ticket (excluding ticketing counter at the airport). The certificate will not be exchanged if the original copy is not presented. Once the flight ticket is issued, it may not be changed or refunded.

According to the published transport terms and conditions, EVA Airways may cancel the flights due to war, natural disaster, or any other force majeure factors. Any other details not specified shall be handled according to the rules of EVA Airways and it reserves the right to make revisions.
